The French decree No. 2025-1137 of November 28, 2025 finally sets the threshold above which a written contract between the advertiser (and agency) and the influencer becomes mandatory.

In concrete terms: as soon as the remuneration and/or value of benefits in kind related to a single campaign exceeds €1,000 excluding tax per year, a formal contract must be drawn up, with the information and clauses required by law (No. 2023-451 of June 9, 2023), otherwise it will be null and void.

A well-drafted contract becomes a real security tool: it structures the relationship, sets out the obligations and limits the exposure to risk for all stakeholders.
